1. Acceptance of Terms
By accessing and using Boston Pallets services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.
2. Services Description
Boston Pallets provides used pallet services including buying, selling, recycling, repairing, and transporting used wooden pallets throughout the Boston metropolitan area. All services are subject to availability and our standard business practices.
3. Pricing and Payment
3.1 Pricing
All prices quoted are subject to change without notice. Final pricing is confirmed upon order placement. Volume discounts may be available for large orders.
3.2 Payment Terms
Payment is due upon delivery unless prior credit arrangements have been made. We accept cash, check, and major credit cards. Net 30 terms are available to approved commercial accounts.
3.3 Late Payments
Late payments may be subject to interest charges of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.
4. Orders and Delivery
4.1 Order Acceptance
All orders are subject to acceptance and availability. We reserve the right to refuse any order at our discretion.
4.2 Delivery
Delivery times are estimates only and are not guaranteed. We are not liable for delays in delivery regardless of cause. Title and risk of loss pass to the buyer upon delivery.
4.3 Inspection
Buyers should inspect all pallets upon delivery. Any discrepancies or damage must be noted on the delivery receipt and reported to us within 24 hours.
5. Product Quality
5.1 Grading Standards
Used pallets are graded according to industry standards (Grade A, B, C). Grade descriptions are general guidelines and individual pallets may vary within grade specifications.
5.2 Used Pallets
All pallets sold are previously used unless specifically designated as new. Used pallets are sold "as-is" and may show signs of wear including cosmetic damage that does not affect functionality.
5.3 Returns
Due to the nature of used pallets, all sales are final. Returns are accepted only for pallets that do not meet the agreed-upon grade specifications, and must be requested within 24 hours of delivery.
6. Buying Used Pallets
When we purchase used pallets from customers, pricing is based on condition, quantity, and current market rates. Payment is made upon pickup. We reserve the right to refuse pallets that do not meet our quality standards or safety requirements.
7. Recycling Services
Recycling services are provided for qualifying pallets. We reserve the right to refuse materials that are contaminated, hazardous, or unsuitable for recycling. Proper disposal documentation is provided upon request.
8. Limitation of Liability
Boston Pallets shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services or products. Our total liability shall not exceed the amount paid for the specific products or services in question.
9. Safety and Compliance
Customers are responsible for ensuring that pallets are used safely and in compliance with all applicable regulations. Heat treatment (HT) certification is available upon request for international shipments requiring ISPM-15 compliance.
10. Intellectual Property
All content on the Boston Pallets website, including text, graphics, logos, and images, is the property of Boston Pallets and is protected by copyright and trademark laws.
11. Indemnification
You agree to indemnify and hold Boston Pallets harmless from any claims, damages, losses, and expenses arising from your use of our products or services, or your violation of these terms.
12. Force Majeure
Boston Pallets shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, labor disputes, or natural disasters.
13. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
15. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
16. Entire Agreement
These terms constitute the entire agreement between you and Boston Pallets regarding the use of our services and supersede all prior agreements and understandings.
